GENERAL TERMS AND CONDITIONS OF USE

SOBRADOS DE STYLE® (hereinafter referred to as SOBRADOS®) is a brand engaged in the marketing and/or importation, on its own behalf and/or through third parties, of clothing, eyeglasses with or without correction and/or light filters, sunglasses, frames, lenses, cases, covers, and other optical items. The website www.sobradosdestyle.com (hereinafter referred to as the Site) is owned by SOBRADOS, and its use shall be governed by the terms set forth in this document.

DEFINITIONS

In these General Terms and Conditions of Use (hereinafter, General Terms), the following terms shall have the meanings indicated below:

"SOBRADOS or SOBRADOS DE STYLE": A brand engaged in the marketing of clothing, sunglasses, and other optical items.
"Site": The website owned by SOBRADOS through which the products offered by the brand are advertised, promoted, and sold.
"Client or Clients": Natural or legal persons who browse and/or register on the Site and who may purchase the goods and products offered by SOBRADOS.
"Store": The section available on the Site created by SOBRADOS for Clients to purchase the marketed products.

1. INTRODUCTION

These General Terms establish a contractual relationship between Clients and SOBRADOS regarding the use of the Site and the purchase of goods and products marketed through the Store. These General Terms will govern the rights and obligations of the parties regarding any product offered on the Site. Clients agree to read, understand, and accept all the terms set forth in this document, as well as in any linked policies and additional pages of the Site, at the time of their registration request or when prompted. These General Terms are deemed accepted from the moment the Client registers on the Site, in accordance with the registration process described herein. These General Terms will remain in effect for the entire duration of the Client’s use of the Site. If you do not agree with these General Terms, we ask that you refrain from using the Site.

2. WHO MAY USE THE SITE

Only individuals with full legal capacity to exercise their rights may use the Site developed by SOBRADOS® and purchase the goods offered there. Persons without such legal capacity, in accordance with Articles 23 and related provisions of the Argentine Civil and Commercial Code, may not make purchases on the Site. The use of the Site by minors or others lacking legal capacity and any acts performed by them will be the responsibility of their parents, guardians, or legal representatives, and will therefore be considered performed by them in the exercise of their legal representation. It is understood that Clients who accept these General Terms and purchase products on behalf of a company, organization, government, or other legal entity, affirm and guarantee that they are authorized to do so and have the necessary authority to represent and bind such entity.

3. REGISTRATION AND VERIFICATION

Use of the Site to purchase goods from the Store requires Client registration. Clients must provide at least the required information to complete and finalize the product purchase process. Those wishing to register as Clients on the Site must provide personal information such as full name, date of birth, email address, and phone number, among others. Clients agree to provide truthful, accurate, current, and complete information and to keep their personal data up to date. Personal data will be processed and stored on servers or magnetic media used or contracted by SOBRADOS, which maintain high physical and technological security standards. Personal data provided by Clients will be handled in accordance with the Privacy and Personal Data Protection Policy, which Clients acknowledge.

4. PRIVACY AND SECURITY

SOBRADOS implements and regularly updates its security systems and control mechanisms for the collection and storage of personal and private information provided by Clients, in accordance with the criteria described in its Privacy and Personal Data Protection Policy.

5. PURCHASE PROCESS

To purchase products offered on the Site, Clients must follow the steps indicated below and accept these Terms and SOBRADOS's Privacy Policy:

Select the desired product and add it to the cart.
By selecting “view cart,” a summary of the selected products (item, quantity, and price) will be shown.
To proceed with the purchase, the Client must confirm the product selection by clicking “Checkout.”
Then, the Client must provide the required billing and shipping information and select the desired payment method.
To confirm the purchase, after verifying the selected products, billing information, and shipping address, the Client must click “Place Order.”
Purchase is subject to the availability of product stock.
After the purchase is confirmed, the Client will receive an email confirmation with the order details.
Purchases will be shipped by courier services at the Client’s request. Shipping information will be provided after dispatch to enable tracking. Delivery will occur within the period specified by the courier, not exceeding 30 calendar days from order confirmation within Argentina.
Prices are listed in Argentine pesos.
Clients must pay any taxes, duties, or fees required for international purchases and shipments.
Purchases may be paid via debit or credit cards, bank transfer, or Mercado Pago.
Financial costs and interest for installment payments will depend on the terms of each bank or credit card issuer. The final price and installment breakdown will be disclosed before purchase confirmation.
Products may also be purchased in person in Rosario, Santa Fe, at "CENTRO ÓPTICO ROSARIO," located at Mendoza 1625.

6. REFUNDS, EXCHANGES, AND RETURNS

If, due to lack of stock or other reasons, SOBRADOS cannot fulfill the purchase after confirmation, Clients may:

Request a replacement product of similar characteristics and price.
Request a full refund, which will be processed within 10 business days. Clients acting as end consumers may request a return or exchange within 5 calendar days of receiving the product. To cancel a purchase and request a refund, Clients must use the "Cancellation Button" section of the Site. SOBRADOS will provide a case number within 24 hours of receiving the request. To exchange a product, Clients must contact SOBRADOS using the email provided in the purchase confirmation within the above timeframe. Requests outside the 5-day period will not be accepted. Refunds will follow the method used for payment. Return shipping costs will be covered by SOBRADOS if the return is made in compliance with these Terms. Returned products must be unused, in original packaging, with all accessories and labels included. Damaged or altered items will not be accepted.

7. WARRANTY

All products purchased through the Site are covered by a 6-month warranty. To claim warranty, Clients must contact SOBRADOS via the email provided in the order confirmation.

8. INTELLECTUAL PROPERTY

Clients acknowledge that SOBRADOS is the sole and exclusive owner of all intellectual property rights related to the Site, including but not limited to trademarks, designs, slogans, patents, domain names, copyrights, and software. The brand name and trademarks of SOBRADOS are the exclusive property of the company. Unauthorized use is subject to applicable legal consequences. Clients may use the Site only as permitted under these Terms and for the purposes stated. Clients may not alter or attempt to alter the functionality of the Site, develop competing products or services based on the Site, or use/copy/transfer any materials without prior written authorization from SOBRADOS.

9. LIMITATION OF LIABILITY – INDEMNITY

SOBRADOS shall not be liable for any direct or indirect damages, including lost profits, data loss, or third-party claims resulting from improper use of the Site or products, or arising from the Client's or third parties' actions. Clients agree to indemnify and hold harmless SOBRADOS from any liability, damages, losses, or expenses (including legal fees) resulting from the improper use of the Site or its products, or harm caused to third parties by the Client’s breach of these Terms.

10. MODIFICATIONS TO TERMS AND CONDITIONS

SOBRADOS reserves the right to modify these Terms at any time. Any changes will be posted on the Site and will take effect 10 days after publication. Clients who do not agree with the modifications may decline them when prompted and should cease using the Site. Clients will be notified about the nature and scope of any changes made to these Terms or related policies via the Site.

11. DISPUTE RESOLUTION

In the event of any disputes arising from the use of the Site or the purchase of products, Clients agree to submit to the exclusive jurisdiction of the ordinary courts of Buenos Aires, Argentina, waiving any other applicable jurisdiction.
