SOBRADOS DE STYLE® (hereinafter, SOBRADOS®) is a brand dedicated to the marketing and/or import, on its own account and/or through third parties, of clothing, glasses with and without correction and/or light filter, glasses for sun glasses, frames, frames, lenses, cases, covers and other optical items. The website www.sobradosdestyle.com (hereinafter: the Site) is owned by SOBRADOS and its use will be subject to the provisions of this document.
Definitions
In these General Terms and Conditions of Use (hereinafter: General Terms), the following words will be assigned the meanings set forth below:
“SOBRADOS or SOBRADOS DE STYLE”: It is a brand dedicated to the marketing of clothing, sunglasses and other optical items.
“Site”: It is the website owned by SOBRADOS, through which the articles offered by SOBRADOS are advertised, promoted and marketed.
“Client or Clients”: These are human or legal persons who browse and/or register on the Site and who can purchase the goods and products offered by SOBRADOS.
“Store”: It is the section available on the Site created by SOBRADOS so that customers can purchase the products marketed.
1. INTRODUCTION
These General Terms establish a contractual relationship between Clients and SOBRADOS, regarding the use of the Site and the acquisition of goods and products sold in the Store. The General Terms will govern the rights and obligations of the parties regarding any products offered on the Site.
Clients agree to read, understand and accept all the conditions established in this document, in linked policies and in additional pages to the Site, at the time of requesting their registration as a user of the site or when requested.
These General Terms will be considered accepted from the moment the Client registers on the Site, in accordance with the registration process described in this document.
These General Terms will govern throughout the period in which Clients use the Site.
If you do not agree with the General Terms specified in this document, we request that you refrain from using the Site.
2. WHO CAN USE THE SITE
Only those people who have full legal capacity to exercise their rights may use the Site developed by SOBRADOS® and acquire the goods offered there.
People who do not have that capacity will not be able to make purchases on the Site, in accordance with the stipulations contained in article 23, following and consistent with the Civil and Commercial Code of the Nation.
The use of the Site by minors or others incapable of exercising and any act that they carry out within it, will be the responsibility of their parents, guardians, managers or curators and therefore will be considered carried out by them in the exercise of legal representation. that they have.
It is understood that the Customer who accepts these General Terms and purchases the products offered in the Store, on behalf of a company, organization, government or other legal entity, affirms and guarantees that he is authorized to do so and has the necessary powers to represent and commit the aforementioned entity.
3. REGISTRATION AND VERIFICATION
The use of the Site for the acquisition of goods through the Store is conditional on the registration of the Client, who must provide - at a minimum - the information marked as mandatory, in order to finalize and complete the purchase process of the products offered.
People who wish to register as Customers on the Site to make purchases must provide certain personal data, such as their first and last name, date of birth, email address and telephone number, among others.
Those who register as Clients undertake to provide true, correct, current and complete information regarding the requested data. Likewise, they undertake to maintain and update their personal data in order to keep it true, correct, current and complete.
Your personal information will be processed and stored on servers or magnetic media implemented or contracted by SOBRADOS, which observe high standards of security and protection, both physical and technological.
Likewise, the personal data provided by the Clients will be treated in accordance with the criteria described in the Privacy and Personal Data Protection Policies, which the Clients declare they know.
4. PRIVACY AND SECURITY
SOBRADOS implements and periodically updates its security systems and control mechanisms for the collection and storage of private and/or personal information provided by Clients, in accordance with the criteria and guidelines described and the Privacy and Personal Data Protection Policies.
5. PURCHASE PROCESS
To purchase the products offered on the Site, the Client must follow the purchase steps indicated below and accept these Conditions and the Privacy and Personal Data Protection Policy of SOBRADOS:
Select the desired product, adding it to the cart.
When selecting “view cart” the details of the chosen products will appear (product, quantity and price).
To complete the purchase, the Customer must confirm the selection of the desired products by clicking on the “Finalize purchase” link.
Subsequently, you must provide the tax and personal information requested, in order to enable billing of the requested purchase and delivery to the address indicated by the Client. Likewise, you must select the desired payment method.
To confirm the purchase, after confirming the data of the selected products, the billing information and the shipping address, the Customer must select “Place the order”.
The purchase will be subject to the existence of stock of the chosen product.
After completing the purchase, the Customer will receive a confirmation message with the details of their order to the email address provided in the purchase or registration process.
Purchases will be sent by parcel or courier services, at the Customer's expense and order. The shipping information will be informed to the Client once the order has been dispatched, in order to enable its tracking by the buyer. The delivery time will be as informed in each case by the company in charge of shipping, but in no case will it exceed 30 (thirty) calendar days from confirmation of the purchase, for shipments within Argentina.
The prices that appear on the Site for the acquisition of products are expressed in Argentine pesos.
The payment of any fee, tax, tariff or duty that must be paid for purchases made and/or shipped outside of Argentina must be borne by the Client.
Purchases made by Clients may be paid by debit, credit, bank transfer and Mercado Pago cards.
The financial cost and/or interest for the acquisition of products in installments will be established and reported by each banking entity and/or credit card issuing entity, as appropriate. In all cases, the final price and the value of each installment will be informed to the Clients prior to confirming the purchase.
The sunglasses and other optical items offered by SOBRADOS on the Site may be purchased by Clients, in the city of Rosario, province of Santa Fe, in the establishment that operates under the commercial name “CENTRO ÓPTICO ROSARIO”, located in Mendoza Street No. 1625 of said city.
6. REFUNDS, EXCHANGES AND RETURNS
If, due to lack of stock or for any other similar reason, after confirmation of the purchase, SOBRADOS is unable to deliver the products purchased by the Client, the Client may:
- Request the delivery of a product with similar characteristics and price to the one originally purchased.
- Request a refund of the money paid, which must be made within a period that in no case will exceed 10 (ten) business days.
Likewise, Customers who purchase the products as final consumers have the right to request the exchange or return of the product purchased on the site, within a period of five (05) calendar days from the delivery of the product.
To cancel the operation and manage the return of the purchased good and the refund of the money, the Client must request it by entering the “Regret Button” section, available on the website. SOBRADOS will not be able to refuse the cancellation of the operation, when requested by the client within the legal period and in compliance with the legal stipulations and the provisions contained in these General Terms. Within 24 (twenty-four) hours of communicating the cancellation request by the Client, SOBRADOS will provide the Client with a code or identification number for the procedure.
To request the exchange or replacement of the product with a different one, the Client must contact SOBRADOS at the email address reported in the purchase confirmation, within the period stipulated above.
SOBRADOS will not accept requests for changes or returns that have not been made within a period of five (05) calendar days from the delivery of the product.
In the event of cancellation of the purchase or when the money is refunded for any reason, the method of refund will depend on the method chosen to make the payment for the purchase whose cancellation is intended.
The costs of resending the product will be assumed by SOBRADOS, when the return is made in compliance with the stipulated abovedently.
In all cases, the product must be returned by the Client unused, in the same conditions as those received, with its original packaging and all corresponding accessories, including identification labels.
Returns of products damaged by use or altered will not be accepted.
7. WARRANTY
All products purchased on the Site have a guarantee for a period of 6 (six) months.
In all cases in which the guarantee is intended to be enforced, the Client must request it directly from SOBRADOS by means of a communication addressed to the email informed in the purchase confirmation.
8. INTELLECTUAL PROPERTY
All Clients acknowledge and accept that SOBRADOS is the sole and exclusive owner of all intellectual property rights derived from or linked to the Site, including, but not limited to: trademarks, designs, slogans, patents, web domains, copyrights and software. .
The SOBRADOS trade name, the SOBRADOS trademark and the products offered are the exclusive property of SOBRADOS. Its unauthorized use will be subject to the consequences provided for in applicable law. Clients may use the Site only within the scope established in these General Terms and in accordance with the purpose expressed in this document.
Customers are prohibited from modifying or attempting to modify any functionality of the site, producing any derivative or accessing any part of the site, to create a competing product or service, or any product or service that contains ideas, features or functions similar to those of the Site. . Likewise, Clients must refrain from using, copying or transferring any type of material contained on the platform, without the proper written authorization from SOBRADOS.
9. LIMITATION OF LIABILITY - INDEMNITY
SOBRADOS will not be responsible for any type of damage, whether direct or indirect; emerging or lost profits; punitive damages; loss of chance or benefits; loss of information or data - among others - when these damages are a consequence of incorrect use of the Site and/or the products offered by SOBRADOS in the Store; or when it is the sole responsibility of the Client or third parties other than SOBRADOS.
Likewise, Clients agree to defend, indemnify and hold SOBRADOS harmless from any liability, against any obligation, damage, loss and/or expenditure of any kind (including costs and professional fees), derived from improper and/or incorrect use of the Site and/or the products offered in the SOBRADOS Store and against damages caused to third parties due to non-compliance with the stipulations contained in these Terms and Conditions.
10. MODIFICATION OF THE TERMS AND CONDITIONS
SOBRADOS reserves the right to modify these General Terms at any time. When this occurs, SOBRADOS will make the modifications introduced public and visible, through notices on the Site. In all cases, the modified terms will come into force 10 (ten) calendar days from their publication.
Customers who are dissatisfied with the modifications introduced may choose not to accept them, when they are asked for their consent when entering the site. In this case, they must refrain from continuing to use the Site and/or the SOBRADOS store.
It is noted that, in all cases in which modifications are made to these General Terms and/or the related policies that are applicable, the Clients will be duly notified about the nature and scope of the changes introduced, through notices to those referred to in the preceding sections.
11. DISPUTE RESOLUTION
In the event of possible and hypothetical disputes that may arise on occasion, due to or as a consequence of the use of the Site and/or the acquisition of the products marketed by SOBRADOS, Clients agree to submit to the exclusive and non-extendable jurisdiction of the ordinary courts of the city of Buenos Aires, Argentina, waiving any other jurisdiction or jurisdiction that may apply.
